By placing a pre-order on Subtle Snacks (operated by Thix Snax, Corp., “Subtle Snacks,” “we,” “us,” “our”), you agree to the following terms:
Pre-orders are advance purchases for products that are not yet in stock and may still be in development, production, or transit. You acknowledge that delivery timelines are estimates only and are subject to change.
Any stated or implied shipping or delivery date is an estimate. We do not guarantee fulfillment by any specific date and are not liable for delays due to manufacturing, supply chain, logistics, regulatory, or other unforeseen issues.
Final products may differ from descriptions, images, prototypes, or specifications presented at the time of purchase, including but not limited to ingredients, nutritional content, packaging, size, shape, or flavor. By purchasing, you accept these potential variations.
Full payment is collected at the time of pre-order. This secures your place in the production queue and allocates inventory.
Pre-orders are generally non-cancellable and non-refundable. We reserve the sole discretion to issue refunds or credits on a case-by-case basis. If we are unable to fulfill your order, you will receive a full refund.
We reserve the right to limit quantities, cancel orders, or refuse service for any reason, including suspected fraud, errors in pricing or product information, or supply constraints.
You understand that pre-ordering involves inherent uncertainty, including delays, changes, or potential non-fulfillment. By placing an order, you voluntarily assume these risks.
To the maximum extent permitted by law, Thix Snax, Corp. shall not be liable for any indirect, incidental, consequential, or punitive damages arising from or related to your pre-order, including but not limited to delays, product changes, or inability to fulfill an order. Our total liability shall not exceed the amount paid for the pre-order.
All products are provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.
Once your order is shipped, risk of loss transfers to you. We are not responsible for carrier delays, lost packages, or delivery issues once the product has left our facility.
We reserve the right to update or modify these terms at any time without prior notice. Continued participation in the pre-order constitutes acceptance of any revised terms.
These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
